What is Form E? 

In simple terms, Form E is a declaration report to inform the LHDN on the number of employees and the list of employee's income details, it is different from an income tax form of an individual or a company.

What is Form EA?

Another name for Form EA is the Employment Salary Statement, which is also known as Form CP8A. According to the Income Tax Act 1967,  the employer is responsible in preparing form EA to his/her employees. This form includes personal details of the employee as well as the amount of income, allowances, commissions, tax-exempt income or benefits, monthly withholding tax (PCB), provident fund, etc for the past year.
It is not needed to be handed to the LHDN.

Who needs to submit Form E?

Every employer must register and submit Form E, which are dormant or have not commenced business are required to register and furnish Form E.

Form E Submission Deadline

Submission via postal delivery:
 Must submit before 31 March 2022
Submission via e-filing
Must submit before 30 April 2022

Do You Know?
You will be liable to a FINE if you failed to submit Form E

What if you failed to submit Form E?

Failure to furnish a return is an offence under Section 120 (1)(b) of Income Tax Act 1967, be liable to a fine of not less than RM200 and not more than RM20,000, 
or to imprisonment for a term not exceeding 6 months or to both
